Terms of Service

Please read these terms carefully before using HowzitUK. They set out your rights and responsibilities when using our app and website.

1. Acceptance of terms

By downloading, installing, or using the HowzitUK mobile application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

HowzitUK Ltd ("we", "us", "our") reserves the right to update these Terms at any time. We will notify you of material changes at least 14 days in advance via in-app notification or email. Continued use constitutes acceptance.

2. Eligibility

You must be at least 18 years old to use HowzitUK. By creating an account, you confirm that you are 18 or older and that any information you provide is accurate.

The Service is intended primarily for South African nationals and their families living in, or planning to move to, the United Kingdom. We reserve the right to suspend accounts that are clearly outside this scope.

3. Account responsibilities

You are responsible for maintaining the confidentiality of your login credentials.
You must not share your account with any other person.
You are responsible for all activity that occurs under your account.
Notify us immediately at legal@howzituk.app if you suspect unauthorised access.
You must provide accurate profile information and keep it up to date.

4. Acceptable use

You agree not to:

Post, upload, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, racist, or discriminatory
Impersonate any person or entity, or misrepresent your affiliation
Distribute spam, advertisements, or unsolicited promotional messages
Scrape, crawl, or otherwise extract data from the Service using automated means
Reverse-engineer, decompile, or otherwise attempt to extract the source code of the app
Use the Service to transmit malware, viruses, or other malicious code
Interfere with or disrupt the integrity or performance of the Service
Collect or harvest user data without our express written permission

Violations may result in immediate account suspension or termination.

5. User-generated content

You retain ownership of content you post (messages, photos, event listings, etc.). By posting content, you grant HowzitUK Ltd a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely for the purpose of operating the Service.

You represent and warrant that: (a) you own or have the right to post such content; (b) the content does not infringe any third-party intellectual property rights; and (c) the content complies with these Terms.

We may remove content that violates these Terms or applicable law, without prior notice or liability.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

7. Intellectual property

The HowzitUK name, logo, app design, source code, and content (excluding user-generated content) are the intellectual property of HowzitUK Ltd and are protected by copyright, trademark, and other laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for personal, non-commercial purposes in accordance with these Terms.

8. Third-party services

The Service integrates with third-party services (e.g., Google Sign-In, Apple Sign-In, mapping services). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or uninterrupted availability.

We do not warrant that the Service will be error-free, secure, or continuously available. We are not responsible for decisions you make based on information found in the Newcomers Guide or other community content.

10. Limitation of liability

To the maximum extent permitted by English law, HowzitUK Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed £100 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

11. Termination

You may close your account at any time in the app settings. We may suspend or terminate your account immediately, without notice, if you breach these Terms or if we are required to do so by law.

Upon termination, your licence to use the Service ends. Sections 5, 7, 9, 10, 12, and 13 survive termination.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
